Which Connecticut owners can use the Form 6B
Sole proprietorA sole proprietor is not treated as an employer for personal workers' compensation purposes unless the proprietor accepts the Act. Form 75 is the coverage-election form for a sole proprietor who wants to be included, and it is also used to revoke a prior inclusion.
LLC memberA qualifying LLC member or manager may elect exclusion using Form 6B. The current WCC directions route the form to the Office of the Chairperson and provide an electronic filing process for Form 6B.
PartnerPartners begin within coverage under the Act's partnership treatment unless all members of the partnership elect exclusion using Form 6B-1. The all-partner signature requirement makes this different from an individual corporate-officer filing.
Corporate officerA corporate officer may elect exclusion using Form 6B and may use the same form to revoke that prior exclusion. Filing proof should be kept with the policy and ownership records rather than relying on an unsigned copy.
Employee threshold: Connecticut WCC says that, with few exceptions, all employers must carry workers' compensation for employees as defined by the Act. The statutory employer definition uses one or more employees for pay, so there is no general multi-employee safe harbor for a business that has a covered worker.
