Construction vs non-construction classification
A state-law distinction that can change workers' compensation coverage thresholds, owner-exemption eligibility, fees, limits, or filing rules.
Many owner-exemption questions cannot be answered from entity type alone because construction can trigger a stricter rule. A state may define “construction industry” by statute, administrative rule, trade list, or class-code reference and apply different owner or employee thresholds.
Florida is a clear example: its Division of Workers' Compensation maintains separate construction and non-construction exemption pathways, with different limits and eligibility conditions. The state's own classification rule controls; an everyday description of the business is not enough.
