Agricultural/farm labor exclusion
A state-law rule that may exclude some agricultural labor from mandatory workers' compensation, often subject to payroll, day-count, family, or other limits.
There is no single nationwide farm-labor exclusion. States define agricultural coverage differently, and the same state may use thresholds, family relationships, days worked, or elections to determine whether a worker must be covered.
Pennsylvania, for example, publishes a limited agricultural exclusion tied to earnings and days worked, while New York requires workers' compensation coverage for farm employees and separately addresses family members and farm labor contractors. The state rule in force for the work location must be checked rather than assuming “farm work” is excluded.
