Election of non-coverage
A formal choice, where state law permits it, by an otherwise covered or coverable owner/officer to reject workers' compensation coverage for themselves.
An election of non-coverage is not a general waiver that any worker can sign. It exists only where the governing workers' compensation statute allows a specified class of owner, officer, member, or manager to reject or be excluded from coverage.
Virginia, for example, permits an executive officer to file a Rejection of Coverage form with the Commission under stated conditions. Florida uses a Notice of Election to be Exempt for qualifying officers and LLC members. The filing mechanics and scope are different by state.
